Man accused of robbing, beating elderly women mistakenly released from jail

City Park has always had a way of drawing people to its Live Oaks and lakes ever since it was created, and to many the area is thought to be one of the safest parts of town, but for one woman, who wished to remain identified, that all changed when she spotted a man watching her get out of her car.

Lostin Lee is back in jail, accused of robbing and beating a woman on Iberville in Mid-City just hours after his mistaken release from prison.

“So I got a little butterfly in my stomach like uh oh. But I thought ok it's probably nothing. Don't profile.”

She said she had just returned from her father’s funeral that August afternoon, and the day got worse as the man chased her to her door.

“He was on me that quick. And I just immediately threw my purse at him. It hit the ground. He picked it up; he looked at me and said get in your house right now before I use this gun on you. And don't you dare call the police.”

In September, police arrested 36-year-old Lostin Lee, who has been in and out of jail for almost two decades. They connected him to several other robberies and said he was targeting elderly white women, and in some cases, beating them unmercifully.

In all, police charged him with seven robberies.

But after never receiving a police report for one case and having a questionable suspect ID in another, the District Attorney’s Office only accepted three of the cases.

“Two of these cases, we did not hear back from the victim, couldn't contact the victim, couldn't locate the victim,” said George Bourgeois with the Orleans District Attorney’s Office.

One of those victims was the woman attacked on City Park Avenue. Eyewitness News caught up with her at her home where it happened; she said she has never been contacted by the D.A.’s office, and her case essentially was dropped.

“If I send a letter out and I make several phone calls and leave messages and I don't hear back from that person, what am I supposed to do?” Bourgeois questioned.

Even though the D.A. had dropped that charge, Lee was still being held in jail on several others. But just a few weeks ago, he was released and police said he robbed and beat another woman the very next day.

The D.A.’s office received that missing police report allowing them to add a fourth robbery charge to Lee’s case. But the Sheriff’s Office claimed they never received the paperwork, and with the original case dropped deputies released Lee, much to the confusion of prosecutors.

“I don't know. We filed the paperwork. The judge issued the bond, issued the capias. And the judge sent his paperwork over,” Bourgeois said.

Police added more charges to Lostin Lee’s growing list. Lostin was arrested again, accused of robbing and beating a woman on Iberville in Mid-City just hours after his mistaken release from prison.

Meanwhile, for one victim born and raised in New Orleans, the fear has become too much.

“I'll be leaving my hometown,” she said, but added she may come back when the crime is under control.

“I don't want to live the next half of my life being afraid to take a walk or park my car and go into my house. And it just seems like there's not enough being done.”
