It was not immediately clear if the trial, which is scheduled to begin May 12, will move or if a jury will be brought in from another parish.

Both the state and the defense filed motions to have a jury brought in from outside the parish.

Judge Conn Regan denied those motions, but granted a stay so the state and the defense could present their argument to the 5th Circuit Court of Appeals.

Both the defense and the state said there are several local witnesses and it would be better to keep the trial in town. The state also argued an out of town trial could cause delays.

Marinello, 70, is charged with second-degree murder in the death of his estranged wife, Elizabeth Marinello, who was gunned down outside a Metairie office building back in August of 2006.
