NEW ORLEANS - The Alabama man who was videotaped rubbing his genitals on a passed-out LSU fan after the BCS championship game was sentenced Thursday to two years in prison as part of a plea deal he agreed to in October.
Brian Downing offered no statement as he was sentenced by Judge Karen Herman. Herman called Downing a "bully" and said his behavior was "reprehensible," noting that he was wise to plead to two counts of obscenity rather than face trial for sexual battery, which carries a maximum of 10 years in prison.
Downing, 33, will report to prison immediately and was recommended by Herman for a boot camp program that could cut his jail time to nine months. Under the terms of his last-minute plea deal on the eve of his October trial date, Downing avoided being forced to register as a sex offender.
Downing was captured in a video that quickly went viral on the Internet. The video shows the drunken LSU fan passed out at the counter of a Bourbon Street burger joint surrounded by a crowd of crimson-clad Alabama fans shortly after Alabama beat the Tigers in the Mercedes-Benz Superdome.
The Alabama crowd can be seen taunting the victim, then poking his face and balancing garbage on him. Downing then pulls out his genitals and rubs them in the victim’s face.
The victim is pursuing a lawsuit against Downing.
