NEW ORLEANS -- Another cannon shot has been fired in the ongoing family feud over Brennan's Restaurant, as the 5th Circuit Court of Appeal threw out an earlier court ruling and gave control of the iconic restaurant back to ousted owner Ted Brennan.
Brennan lost control of the restaurant in a hostile takeover by his brother Pip Brennan, a takeover that was upheld after a federal lawsuit.
But the appeal court ruled that Pip Brennan had no ownership stake to launch his coup.
With the restaurant forced into bankruptcy and the building sold at auction, it is unclear what will happen next in this battle of brothers.
Ted Brennan issued the following statement:
"I am very pleased that the Court of Appeals has recognized that Pip Brennan's seizure of control of Brennan's Inc. was unlawful and I am going to devote my best efforts to repair the damage he has done to the business and Brennan's reputation worldwide. My family and I look forward to reopening Brennan's Restaurant in New Orleans and reuniting with our devoted Staff. Phil Wittmann and his team are the best in the City, have righted this wrong, and we will be forever grateful."
