Letten recuses himself from Landrieu phone caper case

NEW ORLEANS -- The top federal prosecutor for New Orleans has removed himself from the case of four conservative activists arrested last week while trying to capture hidden camera footage in a senator's office, the Department of Justice said Monday.

A Justice Department news release said Jim Letten, U.S. Attorney for the Eastern District of Louisiana, recused himself from the case a day after the Jan. 25 arrests in Democrat Sen. Mary Landrieu's office in New Orleans. Letten's top lieutenant, assistant U.S. Attorney Jan Mann, has taken over.

The news release didn't say why Letten removed himself, and his spokeswoman Anna Christman said she couldn't comment.

One of the suspects is the son of Letten's Shreveport-based counterpart.

Another man who was arrested, daredevil videographer James O'Keefe, has said the group wanted to investigate complaints that onstituents calling Landrieu's office couldn't get through to criticize her support of a health care reform bill. Landrieu's office has said O'Keefe's explanation is feeble, and the case should be thoroughly investigated.

Authorities said O'Keefe used his cell phone to try to capture video of two other men who posed as telephone repairmen and asked to see the phones at Landrieu's office. The fourth is accused of waiting outside in a car with a listening device that could pick up transmissions.

O'Keefe is known nationally for hidden-camera videos targeting the community-organizing group ACORN.

In an interview Monday on Sean Hannity's talk show on Fox News, O'Keefe likened the group's actions to techniques investigative journalists use.

"I really did not think we broke any laws," he said. "I think this is sort of a misunderstanding."

O'Keefe wouldn't explain in detail what the four were doing in the office, but he acknowledged using a hidden camera and a cell phone to record video of their interactions with Landrieu's staff. He said he wants the recordings to be released.   

Also arrested were Robert Flanagan of New Orleans, Joseph Basel of Minnesota and Stan Dai of the Washington, D.C., area, all 24. All four face a charge of entering federal property under false pretenses for the purpose of committing a felony, which carries up to 10 years in prison. They are free on $10,000 bail and are due
back in court Feb. 12.

Flanagan is the son of the Shreveport-based acting U.S. attorney for Louisiana's Western District, William Flanagan.

Robert Flanagan's lawyer, J. Garrison Jordan, said he doesn't know why Letten left the case.

"I have no idea," he said. "It would just be speculation on my part."

Jim Letten has made history in New Orleans arresting, indicting, and convicting every BLACK POLITICIAN in the entire city. He has always been no holds bar and never had a problem indicting EVERYONE. All of a sudden now he has a problem with a case? What is his reason, Because these low lifes are WHITE or because they are REPUBLICAN? If they were messing with VITTER's office I'll bet he wouldn't have a problem with this case. We know that Vitter held out to get him to stay in the job he has now, but give me a BIG BREAK. Fess up!!!!!!!!!

I am sure that Edwin Edwards, Eddie Price, John Hubbard, and Greg Meffert were indicted and convicted because they are secretly black? Race and party affiliation has not been a factor in any of the cases he has presented.

Must everyone play the race card. perhaps it is because of the poor education system and relentless racism. Get the story right before certain people insist on playing the race card. Read the news if you can read and get the facts straight before you show your ignorance!!!

Jim! You've been doing good, so what's the problem? I think the people deserve an excuse for you recusing yourself from this case with these nice college criminaals. Don't mess up Jim, you've been doing good.

Letten left the case because the republican party paid for this crime,and don't want it's top crime czar to prosecute. this was not Prank, this is CRIMINAL! I really disappointed with this decision, this illustrates the political make-up

Maybe because Landrieu supported his re appointment he wanted to make sure the accused were treated fairly. Imagine that in Louisiana. Jim keep up the good work and remain above the line. Many people can't beleive that there is someone in Louisiana, albeit on the Federal level, that isn't on the take. If I am correct, his investigations have hit both the Democrats and Republicians alike. He appears to be color blind......

I want to hear the recordings. I trust this O'Keefe fellow more than I trust Mary Landrieu! We all know that Landrieu and her staff wouldn't answer the phones when it was time to for the vote on that horrible health care bill. And I don't think this has anything to do with race. It has to do with a liberal, not moderate, Democrat who is ignoring the voice of the people. Hopefully, we will vote her out next time she comes up for re-election.

I believe Mr. Letten recused himself for two reasons: 1. one of the accused is the son of the acting U.S. Attorney in Shreveport. 2. Mr. Letten enjoys the support of Senator Landrieu and, as such, should recuse himself. This has nothing to do with color or party affiliation. It is the right thing to do. Please, Mr. Letten, continue to do the job you do so well and root out every crook you come across whether they are black or white, Democrat or Republican. You enjoy the support of the majority of good citizens in the Greater New Orleans Area.

He recused himself because the defense attorney would ask and subpoena records as to why he didn't prosecute Landrieu for bribery. That's why!!!
