NEW ORLEANS - Sen. David Vitter, Congressman Charlie Melancon and Saints head coach Sean Payton are all weighing in on the "Who Dat" controversy that has picked up steam since it was first reported that several t-shirt shop owners had been told to stop selling the shirts because the NFL owns the rights to "Who Dat" on any merchandise that might try to tie the phrase with the Saints.

Vitter sent a strongly worded letter to NFL Commissioner Roger Goodell saying that he will print his own t-shirts and challenging the league to sue him.

This letter will also serve as formal legal notice that I am having t-shirts printed that say "WHO DAT say we can't print Who Dat!" for widespread sale in commerce. Please either drop your present ridiculous position or sue me,” Vitter said in an e-mail.

Vitter wasn't the only one to come to the defense of the local rally cry. Representative Charlie Melancon, who is challenging Vitter for his Senate seat, issued a statement and a petition on behalf of the merchants selling the gear.

"No one owns 'Who Dat' except for the Who Dat Nation," said Melancon.

Saints head coach Sean Payton seemed to agree with the sentiment that has been running strong in the local community.

"I've read a little bit about it. But I don't know enough about it. ... The people who are running these small businesses, I think we're fans of those people," said Payton. "I don't think anyone can own Who Dat, personally. I think it's for everyone to enjoy."

NFL spokesman Greg Aiello said the league acts when it thinks the rights of the Saints are being infringed upon by people looking to make money off of the Saints images.

"If Who Dat is used in a manner to refer to Saints football, we own trademark rights to it." he said. "We get involved when there is use of the Saints logo or “Who Dat” used in combination with Saints logos or football imagery."

Attorney Bruce Spizer says that marketing Who Dat merchandise that is free of the official Saints logo should legally be allowed. He said if t-shirt shop owners have the money and time to wage a legal battle against the NFL, they may have a decent case because of how common the term Who Dat has become.

"You can even lose your trademarks because it becomes so familiar and becomes a generic term," said Spizer. "I just don't see how the Saints can say a term that originated back in the Vaudeville days is owned by the NFL, I don't see it."

Vitter said in his letter that examples of the phrase in minstrel shows and by a local high school football team showed that the iconic rally cry was used in other places before it was adopted by the New Orleans Saints.   

"Who Dat" was probably first heard in New Orleans minstrel shows well over 130 years ago.  Much more recently, but before it was used in connection with the Saints, it was used as a rallying cry by St. Augustine High School in New Orleans,” he said. 

“In the 1980s it was adopted by Saints fans in a completely spontaneous way.  Only later did any legal persons, including the Saints and the NFL, try to claim it through registration.”

According to musician and producer Carlo Nuccio, he, more than 25 years ago, arranged the music of what's since become a sort of Saints battle cry by adding the Who Dat cheer to the song, 'When the Saints Go Marching In.' Aaron Neville recorded it and even performed it on video with Eyewitness News Anchor Eric Paulsen back in the early 1980s.

"We brought the chant into the 'Dome," said Carlo Nuccio.

Around the same time, Nuccio says he officially took ownership of the term ‘Who Dat.’

"I and my partner Steve Monistere were the first to trade mark it," said Nuccio.

According to documents from the Louisiana Secretary of State's Office, he's right. Who Dat was registered in 1983 to Steve Monistere and Carlo Nuccio for the purposes of selling records, tapes, t-shirts, and bumper stickers.

So where did Nuccio get the idea to use Who Dat?

"I first heard St. Aug. say ‘Who Dat’ talking about beating St. Aug.," said Nuccio.

Darren Dixon knows the chant all too well. The St. Augustine High School track coach is also a 1980 St. Augustine graduate and former football player.

"I used to play quarterback about 80 pounds ago," laughed Dixon.

And that's when he was introduced to the combination of those two seemingly simple words.

"I remember in '78 or '79, our fans started the Who Dat," said Dixon. "It was Who Dat, Who Dat, Who Dat say they going to be beat them Knights."

Today, however, it's the NFL trying to claim roots to Who Dat by sending area t-shirt shop owners cease and desist letters ordering them to stop selling Who Dat shirts.

As for Nuccio and his trademark, it apparently expired back in 1993, according to records from the Louisiana Secretary of State's Office. Someone did register the term Who Dat three years ago. The group: New Orleans Louisiana Saints, L.L.C.

According to a Saints spokesperson Dave Lawrence, there are others who hold varying versions of the Who Dat trademark. Lawrence said it's the NFL though who enforces trademark infringement on the team and referred Eyewitness News there for any more information.

Dixon is correct about the time line of 1978-1981 Because I was also playing D-Lineman at Carver During that same era, That chant was being done at Orleans parish High School football games i remember hearing it in the stands in just about every game we played in especially when played in Jefferson or St Bernard parishes, but it was started by someone from Orleans parish schools!!!!

Ok, ok media lets not get into a match before the match we can figure this out after the game. Yes I do remember it being cheered at the HS football games and some other teams in the NFL also used this chant "cin bengals?" Anyway this copy/trademark infringement will not make or break the NFL, Mr. Neville the stores selling the items, all this does is bring DRAMA to and gets us away from our destiny remember that everyone ? Let's concentrate on the things that got us here and pray that our destiny will be fulfilled for this great and nobel cause. Until then lets let the Saints players play this game for themselves we in NOLA already consider ourselves winners, therefore when we do win the game, we can all celebrate. This is bigger than the NFL and who or whatever is claiming to hold the rights to this silly thing. This is a love affair between a city and its team, and the destiny that will be fullfilled. I was a drummer in the band on the field at the Superdome for the halftime show, the drum section danced in attempts to upstage St Aug, and our baritone players did the 'gator', and all thru the game, St Aug was cheering WHO DAT! But actually I remember hearing it earlier in the season at Tad Gormley Stadium when we played against the Carver Rams in their hideous orange and green Rams helmets. I have been telling people just this for some time ...I went to Covington High in 77, 78 & 79 and St. Aug was using Who Dat then. No one should own Who Dat .

I bet Nuccio is kicking himself in the head for letting that trademark expire. Hopefully some of the t-shirt shop owners have the money and time to wage a legal battle per the article. Or perhaps have Mr. Nuccio hit some of the bigger media outlets letting folks know where "Who Dat" came from (i.e., CNN, ESPN etc). It came from New Orleans. As for New Orleans Louisiana Saints, L.L.C., is this affiliated with the NFL or with just the Saints franchise? I seriously don't see how the NFL can just step in and ask folks to "cease and desist" on those shirts with only the "Who Dat" phrase and without the Saints name. If the phrase is now trademarked by the Saints, then shame on the franchise for the greed. This is your chance to allow the local community who stood by your side for so many years to also coin in on the success. Certainly the local economy could use the boost after everything it has been through.

We are a community that has come up with many innovative ideas, sayings and events. Maybe we should scrap Who Dat, get a new phrase, copyright it, and give free use to whoever wants to gain monetarily over it. I propose a contest for a new saying, for the new regime.

Another thing, I have some copyrights and, from what I understand, It's a good idea to get your things copyrighted. You really do not have to copyright something If you can PROVE inception. From the day you invent something (a poem, a song or whatever) its yours if you can prove it.

Everyone should call the Saints main office at 504/733-0255 and ticket office at 504/721-1700 and chant WHO DAT over and over until they hang up. Then call back and do it again. If we keep this up until their lines are clogged, they will get the idea. If anyone has the number for the NFL office, post it wan we can do the same there.

Doesn't surprise me that the support of the fans holds no water with the NFL. They don't care about the families watching, they only care about the people in the stands paying for tickets and fans buying merchandise that they profit from. They are not interested in supporting a crippled city, or families in financial crisis in this recession. How else would they be making their big bucks and living in their mansions. They didn't create the "Who Dat" term, yet they heard the popularity of it throughout the city and decided that they could turn a profit on those two words, and therefore they beat everyone to the punch and trademarked it because they thought of the money, when everyone else was using the term as fun and a way to support there team.. We support the team,and the NFL supports only themselves. Lets not be surprised by this, and lets not expect them to change their minds, they know that people are still going to buy tickets and watch games, and buy merchandise regardless!

Poor wittle NFL. Afraid they are going to lose a penny. Who DatNation take note of when they filed for the trademark- after the Vikings game? That smells worse than the Katrina smell. People in New Orleans have been saying Who Dat before the NFL existed. It's just the way we speak down here. When we say Who Dat it's not just about the Saints. We are simply asking a question. "Who are you talking about?" is shorten to Who Dat. Now that the Saints are in the Super Bowl, the NFL wants to ask for a cut. They weren't asking for a cut back in the 80's, 90's or even early 2000's. Typical greedy corporation.

I believe WHO DAT originated in the late 19th century (in Louisiana) and was picked up by several big bands in the swing era. The Times Picayune has printed a couple of ariticles on this subject and they started before the NFL got into the act. There is no way that anyone can say that they own this phrase, no more than anyone can own the phrase "I love you" because it was used in a song, movie or in a book. I cannot believe how greedy the NFL is.

Who Dat? Who cares! If saints fans had any original thoughts or idea they would be able to skirt the whole NFL issue, make a point, and show some back bone. It takes the saints forever to make it to the big game and now you guys and gals are crying about one of the stupidest catch phrases in pro ball. Almost as bad as a cheesehead! And who ever posted the comment about Katrina and a healing city...OMG, really? I could go one about how the people of NO can't even clean up the trash around their own city, or how the folks in FL were able to return their city to a place people want to live in less than 2 years and NO still looks like a dump. I wouldn't worry to much about the whole "who Dat" thing, after the Saints loose the SB, who dat should be changed to "Who?"

I don't know who owns the phrase, but I know that it's been around a while. When I was a kid after World Ward II, there was a very racist joke that was passed around. It went something like this: Two black soldiers were on sentry duty one night. While they were making their rounds they heard each other. One asked, "who dat"? The other responded by saying "who dat"? The first responded by saying "who dat say who dat when I say who dat"? My personal opinion is that it's a disgusting choice of phases to represent a fine team and a fine city. If the NFL is claiming ownership of this phrase, shame on them. Where is the outrage. It's racist and demeaning. I also know that everyone is having fun with it, but I personally find it distasteful.

Score one for Vitter! Five years ago no one wanted anything to do with New Orleans, people were saying don't rebuild them--they are below sea level. Now that we are a winning team, everybody wants to claim our fame. Tell the NFL Who Dat is our slang. For the past 47 years of my life we used this language--Who dat at the door, who dat you going out with! If anyone deserves some royalties it should be St. Aug High School. Sister-in-law is printing T-shirts, I'm doing bottlecap jewelry, etc., and from now on we will appear in glorious homemade regalia for all games -- so sue us!!! I am a navy wife who's has lived all across the US. I never heard "Who Dat "until I moved to New Orleans in 1994. Coincidentally, I never heard the NFL claim it until the Saints made the Super Bowl. Now they want the $$$$$ from a team they have not always supported because their on top.

hey y'all l think the slogan belong to the people of new orleans, vitters is right go on print your t-shirt dude.the people of new orleans will love it. hey, can l get one free of charge..Laugh! :) the way l see it that slogan has history, of new orleans. and no one shouldn't try to take that away from the city.there is a personal back ground attached to the slogan ,one of your own home boy Aaron neville. has a part in tt (,music.) the history goes back 130 years in minstrels shows where people perform in theater on stages.NFL let new orleans have their slogan. and their t-shirt, enough already, with stupid stuff ,, let's have fun and be happy. with who Dat.and the Saints will start marching in.

Charlie Melancon has a petition going as well. Looks like Vitter and Melancon are using the Saints to further their campaigns. I say leave the politicians out of this and let the people go straight to the NFL with their complaint. Customers gripes will carry more weight with a corporation!!

Just like TANKBARGEGUY, I too heard that joke way back in the early fifties. I have forgotten about it until he brought it up. As he has said, it was and still is very distasteful. I don't even know how the NFL can think of sending a cease and desist letter to anyone because people have been using that phrase in NO since time began.

Has the Times-Picayune started paying royalties? The T-P is a commercial product. It has linked the who dat with the saints and the fleur-de-lis. Maybe Benson and crew can explain what life they lived in the Middle Ages in France. Apparently who dat came from Cincinnati or Pittsburg from before the saints time. But then since it is in a recorded song, thus copyrighted, maybe it is the saints who should be sued for copyright infringement. Way to go Mr. Benson & the NFL, proving once again (1) how stupid they are in doing this while the Supreme Court of the US is considering their overbroad anti-trust claims and that (2) they really are magic, turning the saints back to the 'aints just before the super bowl. They certainly do not deserve the loyalty of the fans for the last 40 years and they do not deserve the name saints (or especially to have it capitalized). What a sad state of affairs.

"Who Dat?" goes back to at least WWII. Our pilots flying in formations over Europe were supposed to be quiet, but boredom would take over and someone would come over the radio and exclaim "Who Dat?", then someone would answer "Who dat say who dat?" and so on. The leader would finally come on and tell them all to be quiet. Sometimes, someone would say "Who dat" to that, and there they would go again. I have an article from the Miami Herald from the 40's or 50's with that very story. The NFL is reaching and it's very sad.

this is getting way out of hand. Why would anyone expect to be able to manufacture and sell Saints merchandise without the Saints and the NFL wanting their cut? the small businesses are around here are the greedy ones. If you want to sell Saints stuff then go get licensed by the NFL. The Saints is an NFL organization. The NFL has the rights to all merchandise sales having to do with their organizations. A black and gold "who dat" shirt with a fleur de lis on it is clearly a saints shirt. Now, you must realize that if a high school makes a who dat shirt in their school colors with their own mascot name then thats fine. The NFL isn't trying to get a profit from that. This whole thing is simple but some people are ignorant and cant understand what's going on.

One would have to go back to 4th Century France to see the fleur-di-lis on just about everything and everybody who was royalty. It appears on armor, clothing, furniture, swords, shoes, and god knows what else. Is the NFL going to file a suit against the whole French nation? Or,maybe FRANCE should sue the NFL. By the way, there are several examples I came up with in which the fleur-di-lis is used in black and gold settings. Oh, MY GOD!
