KENNER, La. – A Kenner man is facing charges for the death of an unborn child and driving while intoxicated after an accident with a vehicle left two women injured and took the life of an unborn baby one woman was carrying, according to the Kenner Police Department.
Bernal Lino Aguilar, 48, was charged with third degree feticide, operating a vehicle while intoxicated, operating a vehicle while under suspension for DWI, vehicle negligent injuring, first degree vehicle negligent injuring and reckless operation of motor vehicle.
Aguilar has “a long history of arrests for intoxicated related offenses,” including pleading guilty to DWI-3rd offense in 2003, according to the release from Kenner police.
Sunday around 6:45 p.m., after failing to yield, Aguilar hit a vehicle at the intersection of Alabama Street and Vintage Drive. Police said two women inside were injured. The driver received lacerations to her face and knee, while the 18-year-old passenger, who was seven-months pregnant, complained of abdominal pain. She “sustained a lacerated uterus and the unborn child perished as a result of the injury. The female passenger underwent surgery and remains in ICU in critical condition.”
Before the crash, police said, that a witness spotted Aguilar driving the wrong way in the 3800 block of Chateau Boulevard. The witness saw Aguilar stop at the intersection of Alabama and Vintage, and then pull into the path of the vehicle with the two women inside who were headed west on Vintage.
Aguilar is also facing charges for 4th offense or more DWI and possession of a drug without prescription from a Dec. 5, 2011 arrest, according to police.
