NEW ORLEANS - Trung Le, the man accused of participating in a gunfight that left one person dead and nine injured on Bourbon Street on June 29, is fighting extradition from Mississippi where he is currently in custody.

Police believe Le fired the initial shot and then engaged in a gun battle with another man, who has not yet been identified.

Le was arrested Friday at a friend's home in Gulfpor, Miss., and taken into custody by members of the NOPD's violent offenders unit and U.S. Marshals.

According to the New Orleans Advocate, Le had a hearing Monday in Harrison County, Miss.  His refusal to be moved across state lines voluntarily means Gov. Bobby Jindal will have to issue a warrant to Mississippi's governor.   The New Orleans Advocate quoted the judge in the case saying the process could take several weeks.

Brittany Thomas, 21, of Hammond, died as a result of the shooting. Nine others were injured, including a woman from Australia who lost more than half of her teeth from a gunshot.
