NEW ORLEANS -- It's a crime that shocked the Bywater neighborhood of New Orleans.
A young couple walked along the 3800 block of North Rampart Street around 9 p.m. Thursday when a man approached them with a gun. Police say the gunmen forced them into a dark courtyard behind the former Frederick Douglass High School.
According to investigators, the man sexually assaulted the woman, and at some point, her companion was able to disarm the attacker and open fire.
Police records identify the dead man as 26-year-old Samuel Raines. Raines had a single gun shot to the head.
"I think it's sad for the neighborhood; it's unbelievable that something like that would happen," said Shanique Tate who lives up the block.
WWL-TV legal analyst Chick Foret called it a justifiable use of deadly force. "Louisiana law is very clear," said Foret. "Was the force used? Was the actions taken reasonable and necessary to protect the other person? It's the Defense of Others law."
The victim, turned shooter was not charged with any crime.
"Thank God that her boyfriend was there to help her out," said Bywater neighbor Thierry Guillemin. "I can imagine if he hadn't been there. To imagine that happening to my wife, I guess I would react the same way."
"I think that the guy honestly did a good job," said Tate. "He saved his own life and his girlfriend's life."
Neighbors say it's terrible, upsetting that something like this would happen, after hours, at their neighborhood school.
"My kids go to that school," said Tate. "I wouldn't want something like that happen while they're at school or after school."
"Over the years, we've seen things happening, but recently, not really," said Guillemin. "It has gotten a lot better. But, of course it's New Orleans. We are not surprised."
Police are now expected to turn the case over to the Orleans District Attorney's Office for further review.
"I'm certain they'll be no action taken," said Foret. "The matter will not be presented to the grand jury and they'll never be any charges filed against victim, turned shooter."
Police recovered a gun at the scene and are in the process of determining the origin of the weapon.
