Burglar sues victim after man catches him, beats him up

ST. PETERSBURG, Fla. – A Florida inmate is suing the man he's convicted of burglarizing, claiming the man and two others roughed him up during a citizen's arrest. Michael Dupree is serving a 12-year sentence for burglary and cocaine possession stemming from a 2007 break-in of a van in St. Petersburg. Dupree allegedly stole a bicycle locked inside and was apprehended after the owner, Anthony McKoy, saw him with the bike down the street.

Dupree said McKoy and two others pointed a gun at him, handcuffed him and placed a knee painfully in his back. He's seeking $500,000 for disabilities and distress suffered during the takedown.

Dupree filed the civil lawsuit on his own, without the help of an attorney.

After being served with the suit, McKoy said, "I thought it was a joke. I'm the victim."

That,s why if someone breaks into your house, you fear for your life and you shoot him. Make sure he is dead.

The judge should allow the suit to be heard, but allow Mr. McKoy (the owner of the bike) to countersue for damages he suffered in the takedown and holding of the crook, along with emotional and punitive damages. The result of the suit is that nothing be given to the crook and a hefty sum be paid to the bike owner. Make the payment of these damages in full a requirement prior to the release from custody for the crook. Perhaps then the crook would think twice about filing such a suit the next time. Well, that assumes that the crook has any brains to think with that is!

This is a sign of how our society has deteriorated. Ask yourselves why should any court accept a lawsuit from a burglar? The burglary victim is the one who should be suing the burglar, not vice-versa.
