NEW ORLEANS -- New Orleans Saints defensive end Bobby McCray was arrested early Tuesday and charged with driving while intoxicated and other counts, police said.

Police spokesman Gary Flot said McCray, 28, was stopped by an officer who saw him speeding about 4:30 a.m. Tuesday. He was booked into Orleans Parish Prison on charges of driving while intoxicated, speeding, careless operation of a motor vehicle and not having his vehicle registration with him.

A jail spokesman said McCray was released on his own recognizance around 7 a.m.

McCray refused to take a breathalyzer test, police spokesman Janssen Valencia said.

"You have the right to refuse the test, but it has consequences," Valencia said. "Those include arrest and losing your license."

A person suspected of driving drunk in Louisiana and refusing the breath test automatically loses his license for one year.

Flot said McCray did not resist arrest.

McCray was signed to a five-year contract in March 2008, and took over as the starter during the last half of the season when defensive end Charles Grant was injured. He responded with 37 tackles (26 solo), the second-highest total of his career, and a club-high six sacks.

A seventh-round pick out of Florida in 2004, McCray played his first four seasons with Jacksonville.

This season, playing as a backup, McCray has appeared in all 15 games, and has 10 tackles and 1.5 sacks.

"We are aware of the situation involving Bobby McCray and we will let the legal process take its course," said Saints spokesman Greg Bensel.

McCray's attorney, Donald Foret, said he planned to talk to McCray later Tuesday and did not comment further.

The Saints (13-2) have clinched the NFC South title, a first-round bye. With Chicago's victory over the Vikings Monday night, they will play all their playoff games at home.

The players had Tuesday off.

just goes to show you where this team is headed, instead of concentrating on football and how important this season is, he goes out and drives drunk. like a i said before its the same old saints, you people r too blind to see it!! Another distraction for a failing football team. He should be benched and let go, no tolerance at all, that is just inexcusable. Another high paid player who thinks he can do what he wants cause he is an professional athlete. And before anybody bashes me about this think about your loved one who could have been driving and he hits and kills them!! Enough said.

shellgg said on December 29, 2009 at 12:38 PM

let's not make this more than it is although I do believe it is a distraction for the team. He does need to be benched.

I dont' understand why there is so much hate for a team that is 13-2 and has for the first time in history gotten homefield advantage throughtout the playoffs. There are other teams in the NFL playing badly at this time and no one is giving them s---t. Cut them some slack. The season is NOT OVER YET! Peyton has NO TOLERENCE for the players screwing up. You have seen that in the past so get over it and wait until we see what happens. GO SAINTS!

I am not taking up for anyone that drives drunk, but do ya'll relize that he may of had only 2 or 3 beers. That' all it takes to go over the limite. Worry about important things, not BS like this story.

Don't you think your being a little unfair whowhat (pos t#1). Few things in life are more stupid than a DUI. But to compare the dumb actions of one player to the team as a whole is absurd. Especially when this team has class acts on it like Drew Brees. You sound sort of like a buzzard circling overhead waiting for the Saints to die so you can pick their bones. I can assure you, its a lot more fun being a Who Dat!!!

musicfan12 said on December 29, 2009 at 1:25 PM

To "dontgetit"...Important things??? So drunk driving is not an important issue? Obviously, it would probably take a guy like this to kill someone in your family by DUI to make it an important issue for you. Laws are laws; and are there for a reason. Look, the bottom line is, he was speeding (which is probably why they stopped him) - combined with careless op (probably driving stupidly WHILE speeding) and no registration. Regardless of how many drinks he had, he knew the consequences and chose to act irresponsibly anyway. I have no pity for people like this.

I am so sick of reading all the negativity about the Saints. Let's take a minute and look at all the positive things these men have done for our beautiful city OFF the field.....murder rates are down, 911 calls go down, people are uniting, the city is getting national recognition. Whowhat, can you say you've done ANY of those things for the city? I think not. Did McCray make a mistake, yes, no one is perfect. So back the heck off and cheer our boys on. They need us now, like we needed them. Bless our Saints for everything that they have done. A Superbowl victory would be awesome, but I will never forget what they have done for us. So, like yo momma taught you ---- if you have nothin' nice to say, don't say nothin' at all!!!!!! GEAUX SAINTS!!!!!!!!!!

bayounola said on December 29, 2009 at 1:46 PM

Hey WWL not sure who posted this story but in the State of Louisiana we to not have DUI like other states. We have DWI arrest (Driving While Intoxicated), La RS 14:98. Keep up the good work great site WWL is my home page for the past several years.

Hey, the guy was just celebrating the Bears win. Give'em a brake!

whowhat said on December 29, 2009 at 1:54 PM

whodatfan, I can say one thing for sure I have never driven drunk!!!, But hey if he would have killed someone it would have been okay because he plays for the saints and they just might make it to the superbowl, so lets forget about the life he might have took as long as they win. So I ask you what's more important a LIFE or SUPERBOWL!!, If you answer superbowl your an IDIOT!! as far as the negativity, you all can't take when people show you the bad things or things that are wrong, you look for excuses instead of facing reality. as far as the murder rate and crime, its only what the media and police department want to report, its worse than u think. Shellgg, "LET'S NOT MAKE MORE THAN IT IS" was your quote, but if your family member would have been killed by him, it would be a big deal then right? fanmet, "Few things in life are more stupid than a DUI." was your quote. same goes for you. you people have your priorities all screwed up.

kknelson44 said on December 29, 2009 at 2:25 PM

DUI/DWI whats the difference? no matter what state calls it what, it's the same thing, you could have only had 1 drink or beer and depending on when it was you get stopped it's gonna show you over the limit, so don't be so quick to judge, you don't know the whole story.

Whowhat, you are obviously not a Saints fan, or a New Orleans fan for that matter. So how about going back to whatever hole you crawled out of and keep your nasty comments to yourself. I never said anything about condoning drunk driving. You're so caught up in your own idiotic world that you completey missed the point of my post. Please take your comments elsewhere and leave our boys and our city alone. To my wonderful Saints - Superbowl or no Superbowl, your true fans will love you and support you no matter what. GEAUX SAINTS!

whowhat said on December 29, 2009 at 2:43 PM

ROBIN57, when McCray signed a contract to wear the uniform of the Saints he agreed to represent the New Orleans Saints and the city as a professional. He is sports figure and should have known better. So to say not to bash the Saints is wrong, he plays for that organization and is responsible for his actions as a Saint and a human being. KKNELSON if only one beer can show over the limit, then he had one to many if he knew he was going to drive. like I said you all have excuses for his actions, instead of saying he was wrong, which he was. You all don't want to hear the bad things, just the good ones. you are a disgrace to all true saints fans, a real person knows right from wrong and takes responsibility for them, obviously, you are not one of them. let me guess, its everybody else's fault, not yours, right when you do something wrong?

mjguillo said on December 29, 2009 at 2:48 PM

Don't the Saints practice on Tuesdays? So this means that the guy is out all night partying the night before he has to practice. At best he shows up with a hangover, at worst still drunk. Not condusive to focusing on practice. I don't know about anybody else, but when I have to work the next day, I don't stay out all night partying the night before. This could explain a lot of whats been happening the last few weeks. How many other of these guys are out partying till all hours during the week when they should be preparing for their next opponent - we would have never known about this one if he hadn't gotten caught. This is unacceptable to any team who is serious about trying to be champions. If Sean Payton (and the players) are serious about chasing a championship, this guy has to be held accountable.

whowhat said on December 29, 2009 at 3:03 PM

whodatfan like i said before you all can't take the negative media coverage for your team, just looking for excuses to make yourself feel better. I am not a Saints fan, i agree with u on that. I grew up in new orleans and still live in new orleans and got tired of having my heart broken by a organization owned by a used car salesman who thinks his S&^T don't stink!!! and players who make way too much money!! but I did plan for the future, I bought stock in the Kleenex company and I am sure I will be very rich once all the fans line up to buy them after your Saints loose in the first round. LOL!!! Just Joking, but to be fair to the Saints Fans, you are the best fans I have ever seen in any professional sport, and that I know because I am surrounded by them.

Dispatch: Black man driving a luxury car. Must be a drug dealer. Since we couldn't find drugs we book him with DUI.

whowhat said on December 29, 2009 at 3:21 PM

billybear3 are you black or should I say colored? or just another saints fan making excuses? Black, white or whatever color he may be he broke the law, period!!! People quit making excuses! This is why your city is a mess right now, you all bring out the race card on everything!! It is a shame because New Orleans used to be one of the most beautiful cities, but now I can see why people shy away from the city. Billybear3 so you are saying he was stopped because he was black? How about he was maybe driving and was all over the road and they saw that first, ever think of that?

saintsfan985 said on December 29, 2009 at 4:38 PM

whowhat- to say that the saints are a failing team is totally rediculous, and plenty of people have driven drunk, and just because youre an athlete does not mean you are supposed to be perfect, everyone mkaes mistakes.

macarpen said on December 29, 2009 at 5:02 PM

What is pathetic is that this "man" who plays professional football is a role model for our youth-- wish he would have thought about that before getting behind the wheel of a car while intoxicated. If he would be focusing on his job/career in football, instead on getting drunk, maybe we could look up to him, but instead we now have to explain to our children how this man made bad choices and how he is not a good role model... The players should realize, that when you are at the top, the fall is much harder...

billybear3 said on December 29, 2009 at 5:46 PM

whowhat: Until you are a black man and been pulled over 50 times a year because you drive a luxury car you have no idea what's it's like. I've never been arrested because of it or even a ticket but, 50 hours a year of my life is a lot of time to lose because ignorant cops are profiling you.

billybear3 said on December 29, 2009 at 5:51 PM

whowaht: Wiki's definition of DWB: Driving While Black, abbreviated as DWB, is a phrase in the contemporary American vernacular that refers to the criminalization of black drivers. An alternate phrase, Driving While Brown, is more encompassing, referring to the crime of being a non-caucasian driver. "Driving While Black" is word play on the name of a real U.S. crime, driving while intoxicated. The phrase implies that a motorist may be pulled over by a police officer simply because he or she is black, and then questioned, searched, and/or charged with a trivial offense. This concept stems from a long history of racism in the United States. The term refers to racial profiling, which is used by police and other law enforcement officials.[1] Variations The related concept of "shopping while black/brown" refers to the notion that non-whites are subject to increased surveillance while shopping. Other plays on the phrase include "walking while black" for pedestrian offenses,[2]

tingeo said on December 29, 2009 at 7:39 PM

I agree whole heartedly... But you seem awful angry towards the Saints and the City... I too have benn broken hearted many times from our boys in black and gold, but we still need to believe........What he did was DEFINITELY wrong and he can't get away from that he isn't that rich...I too may have been guilty of this before... just not caught... and every time i am very thankful for my bad decisions not harming someone else, but you live and learn....

whowhat said on December 29, 2009 at 7:55 PM

Hermione, I never said I was better than anybody else anywhere in my statements, its just funny how some people don't see anything wrong with what he did or they just want to blow it off, like water under a bridge. By the way I don't bash the Saints I tell it like i see it and you all don't like it cause it is negative. All of my comments are not negative on the Saints, if they do good I praise them, if they do bad they hear it too, but there is one thing I will never do and that is make excuses for them when they play bad and blame it on someone else. I think they have a very good team, they just seem to fall apart when it counts, but hey that my opinion. The offense, defense and special teams are all to blame just not one individual. I hope for you all Saints fans they can get their act together before the playoffs, cause if they don't it will be a long day in the dome, Good Luck!

bikersaint said on December 29, 2009 at 8:01 PM

To those who characterize the event as "he made a mistake" I give this insight. A mistake to me, is when you do something out of ignorance of the rules or the consequences. When you break the law, by a conscious decision, in my mind it is not a "mistake" by that definition. It is more of a "purpose". Similarly we say that someone driving at a high rate of speed failed to stop and crashed into someone, had an "accident". No, it was a purpose. He should not have been traveling at an unsafe speed. If something happens when you are doing something wrong, it ain't no accident. Finally, to anyone who thinks the poh lice were harassing him, wonder if Dante Stallworth wishes someone would have pulled him over BEFORE he hit that pedestrian?

whowhat said on December 29, 2009 at 8:41 PM

Bikersaint, could not have said it better!! thank you, maybe this will open their eyes to what is more important. And one other thing to ad one man's bad decision on a Team does affect everybody around him. This is a Team sport not and I sport.

sassyfrass said on December 29, 2009 at 8:53 PM

I say he probally wasn't the only saints player that was parting, the whole team was probally together watching the game, and when the bears made that T/D in overtime, the team had something to party about. I do not condone DWI, but I don't think he should be benched, come on, he was happy and over-did-it. I would have been parting ,( at home of course)if I wouldn't been down sick.

shortcake said on December 29, 2009 at 9:45 PM

Driving drunk and speeding at 4:30 A.M. Thank God he didn't kill someone. Shame on him, he deserves to have his license taken away. So many overpaid athletes seem to think they can do as they please with no regard for the law. The Saints will never be winners with jokers like McCray causing trouble for the team.

booboonaught said on December 29, 2009 at 11:24 PM

whowhat so when are you moving? If the city is so bad then why do you stay, is it just to bash it. You are however right in the fact that driving under the influence is major. But then again he may now realize the error in his way without a death on his hands. Back to the beginning statement... You are a key reason things won't change around here. Your one of those that are quick to point a finger and last to stand up and make change. It must be a lonely world where your from when you bash on everyone. I can only hope that your next mistake is met with maximum consiquence!!

midcity42 said on December 29, 2009 at 11:35 PM

I am not surprised they charged him with no registration. That paperwork is the first thing the police throw away during an arrest in order to trump up charges.

whowhat said on December 30, 2009 at 10:50 AM

so Midicty42, how many more excuses can you come up with for him? let me guess the same thing happened to you. Booboonaught I don't live in the city anymore and thank god I don't. the key reason the city will never change is not because of me, it is because of idiots like you who re-elect a racist and hateful mayor who will do everything in is power to bankrupt and leave the city in ruins. Just look at all the corruption in your city and politicians, judges, congressman who are all going to jail for their crimes, so don't you blame me for your problems, look at who you elected and bear the consequences of your vote. enough said. By the way, what McCray did was not a MISTAKE!!, he knew what he was doing before he got behind the wheel of that car. he knew what he was doing and decided to do it anyway, he deserves what he gets. And if I break the law then I deserve what ever the punishment is, it is called being responsible for your actions.
