CONROE, Texas Police arrested a 29-year-old man Monday evening in connection with an incident involving his infant son being abandoned at the site of a rollover accident in July.

James William Hammons Jr. has been charged with child abandonment, driving while intoxicated with a child under 15 years of age and felony failure to stop and render aid, DPS said.

According to investigators, the incident happened around 10:30 p.m. on July 20 on East Williams Road and South Williams Road.

Witnesses rushed to the scene and found a baby lying face down in the road and bleeding.

'They thought it was a doll that came out of the vehicle, they didn't realize it was a child,' said Jake Millsap, a neighbor. 'It was laying face down, until they flipped him over and was blinking at them.'

'They had an argument and he took off with the baby, and the baby wasn't in a safety seat,' said another neighbor.

Officials said the child had been ejected from a Ford Fusion, which was upside down about 20 feet away.

PHI Air Medical transported the infant to Memorial Hermann Hospital in Houston.

The child has since been released and is in foster care. One store clerk says he saw Hammon 24 hours ago buying a Monster energy drink from the corner store.

Hammons is being held at the Polk County Jail.
