SLIDELL, La. - A judge has formally dropped the charges against Mark McCabe, the Slidell man who has been detained in South Sudan since October, according to officials in Sen. David Vitter's office.

The Minister of Justice has to sign a paper to allow him to leave.

'There should not be any issue with this, but it is not scheduled until December 6,' officials said. 'We are working on trying to expedite that date.'

McCabe is currently at the Ambassador's office working out details for his passport and departure.

He will stay at an embassy compound for safety.

McCabe was in the African country on a business trip when he became detained on a kidnapping claim.

He suffered a mild heart attack in prison.
