Hosanna pastor will stand trial in Tangipahoa
08:34 PM CDT on Wednesday, July 23, 2008
Former Hosanna Church Pastor Louis Lamonica will stand trial in Tangipahoa Parish.
That decision came Wednesday from Judge Zoey Waguespack.
Lamonica's attorney, Michael Thiel argued for a change of venue. He said publicity in this case was great, and his client could not get a fair trial in Tangipahoa Parish.
Defense attorneys subpoenaed a copy of an Eyewitness News story from February -- an interview with Nicole Bernard as an example.
In ruling to keep the trial in Amite, Judge Waguespack noted she will entertain the change of venue motion again if they can't seat a jury.
In another victory for the prosecution, Judge Waguespack ruled alleged incidents involving other victims could be brought up in trial.
The four counts against Lamonica all deal with the two boy victims in the case.
Judge Waguespack says incidents involving the little girl victim can be brought up because they could show the defendant's lustful disposition towards children.
Wednesday's hearing lasted roughly two hours, and attorneys also argued about how the jury will be picked.
For now, the trial is scheduled to begin August 18, but Thiel is asking that the trial be delayed.
He says there's not enough time to hear all the motions remaining in this case. Tangipahoa Assistant District Attorney Don Wall says there's plenty of time to get everything done, before the trial begins.
