Dong Phuong must pay more than $127,000 in back wages to workers

Department of Labor investigators say Dong Phuong bakery did not pay employees overtime when they worked more than 40 hours a week.

The U.S. Department of Labor has ordered Dong Phuong bakery to pay more than $127,000 in back wages.

Investigators say Dong Phuong Oriental Bakery Inc. violated the Fair Labor Standards Act by paying employees straight time for all hours worked and not paying employees overtime when they worked more than 40 hours a week.

Investigators also say Dong Phuong violated record-keeping provisions by not keeping payroll records for some employees and paying them cash with no documentation.

The bakery must now pay $127,128 to 43 employees to settle the violations.

“Employees who work long, hard hours to make ends meet count on being paid for every hour they work, including the time-and-one-half the law requires when they work overtime,” Wage and Hour Division Regional Admin Betty Campbell said.
